Permitting In Unincorporated Orange County.

California requires every jurisdiction to allow ADUs in residential zones, and Orange County's standards track those state rules. The County runs a 60-day initial review, and most projects go from submission to approval in three to four months. The County's own Public Works ADU guide is the best starting point.

One important caveat: these rules apply to unincorporated Orange County. The county's incorporated cities can adopt their own ADU ordinances, so always confirm which jurisdiction your parcel falls under. Check your lot and we will sort that out for you.

Size And Height Limits.

Detached ADUs can have up to 1,200 square feet of floor area. Height is generally capped at 16 feet, rising to 18 feet when the unit is within a half mile of public transit or on a lot with an existing multistory multifamily building.

Attached ADUs can reach 50% of the main residence's floor area, with the same 1,200 square foot ceiling, and in most cases up to two stories. Local rules must allow ADUs up to 25 feet tall, or the height allowed for the primary dwelling, whichever is lower. JADUs must sit inside an existing or proposed single-family home and run 150 to 500 square feet. The County imposes no minimum lot size, and new ADUs need only 4-foot rear and side setbacks.

Design Standards And Parking.

Unincorporated areas generally add no aesthetic requirements beyond the state's basic standards, but incorporated cities can. In the City of Orange, for example, an ADU should use at least two exterior colors, incorporate at least three architectural elements that add visual interest (trellises, exposed rafters, columns, bay windows), and use a roof form and pitch consistent with the main house. Historic districts can layer on additional compatibility rules.

Parking is straightforward: one space per detached ADU, waived if the property is within a half mile of public transit, in an architecturally or historically significant district, or within a block of a car-share vehicle. Attached ADUs, JADUs, and studio units with no separate bedroom need no parking at all. The County's ADU chapter in the code of ordinances spells out the details.

Who Can Build And How Many Units.

ADUs are allowed on any lot zoned for residential use, single-family or multifamily, including mixed-use zones that permit housing, as long as a primary dwelling exists or is being built.

On a single-family lot you can add one ADU and one JADU, but the JADU comes with a string attached: either the main home or the JADU must be owner-occupied. No owner on site means you are limited to one ADU. That works out to up to three units on the lot when owner-occupied, or two when not.

Multifamily properties get more room: non-livable areas like storage rooms, boiler rooms, and garages can become internal ADUs, up to 25% of the existing unit count (rounded down), plus up to two new detached ADUs regardless of building size.
